When using the ThemeFlood website or when purchasing from the ThemeFlood website, you agree to the following terms and conditions; by which we conduct our business.
Customer support policy
Customer support is provided predominently via email and in English. You can access contact details through the support page. We will endeavour to always respond to messages quickly and to convey reliable information to you in a fast and friendly manner. At times you may be sent links to existing online resources, like articles in the Knowledgebase or the RapidWeaver forums. Support is prioritised for paying customers of ThemeFlood or Stack4Stacks addons.
Please help us to help you. We reserve the right to not respond to messages of a vague nature (e.g. "it doesn't work") or messages that fall outside of our normal support remit (like support requests for addons developed by other companies or matters we have no control over). Of course, rude or disrespectful messages are all automatically deleted and if it transpires the same question or message has been posted to multiple locations then these will get handled as junk and ignored too.
Under the United Kingdom's Distance Selling Regulations (2000), you have the right to cancel the contract for the purchase of items within a period of 7 working days, beginning with the day after the day on which the item is issued to you. Please note that we are unable to accept cancellation of, or returns for, digital items once downloading has commenced.
Accidental duplicate purchases will be refunded upon request (proof of the first purchase is required). Likewise wrongly purchased products will be exchanged upon request.
If you have encountered a fault or problem with a product, please get in contact with us first via the ThemeFlood support page. We are willing to help diagnose problems and provide bug fixes, free updates, exchanges or workaround solutions to issues you may have found. It is your responsibility to follow published guidelines and provide sufficient information to aid troubleshooting (like details of the product being used and a link to a live [published] demo site).
It should be emphasised that free demo versions are provided for all the products sold through this website. Therefore you have ample opportunity to download, install and test any products for suitability before purchase. This way you can totally ensure that what you're buying is correct for your needs, and you can test a product against existing content or addons from other companies. We can also answer any pre-sales questions you have. All purchases are final. Refunds will not be given.
You may request updates (new copies) of addons previously purchased from the ThemeFlood website. Update information is already extensively provided on the website. Free updates are provided at our discretion. It's your responsibility to provide adequate proof of purchase when requesting updates. Typical proof of purchase could include a copy of the purchase receipt or invoice or the name and email address of the purchaser. Screenshots of addon icons or links to published websites does not constitute as proof of ownership. We reserve the right to refuse the issue of updates in instances where there is disputed or insufficent evidence to prove that a customer is a genuine purchaser of particular addons being requested.
Free RapidWeaver themes
The ThemeFlood website has always listed a selection of RapidWeaver themes for free download. These have been generously provided to make-up for a shortfall in quality themes supplied with RapidWeaver and to give new users a taste of how addon themes function. Many of the designs contain premium features, like ExtraContent containers, Font Awesome icons, embedded web fonts, lightbox support and FreeStyle containers. These free themes can be used an unlimited number of times in personal or commercial projects. Compared alongside paid (premium) themes, free themes generally have less colour and style settings.
Before you can download free themes, you'll be required to setup a Paddle account (if you've not done so already) during the checkout process. This is done so that we can monitor how many times free themes are downloaded. It also means that future free or paid purchases you make from the ThemeFlood website will be processed quicker. The download link for the free theme is emailed to the address you provide. Please ensure the email address you provide is correct and can accept incoming messages! We do not resell or use your provided email address for any other purposes, like marketing.
Free themes remain the property of ThemeFlood. You are granted a license to reuse the theme in your projects. Most free themes include an attribution, normally within the website footer. This acts as an advertising link back to the ThemeFlood website. The attribution MUST remain on display and unedited at all times. We have a good idea of where free themes are being used, and websites that are found to have illegally edited or removed the attribution will be reported (we'll request the hosting company suspends the website on the basis of a copyright breach). So please save yourself the hassle and refrain from removing attributes, unless you've been granted prior permission to do so.
If you wish to have attributions removed from a free theme, you can make a contribution. We very much appreciate any contributions made; it ensures we can continue to provide free themes and keep them updated for you. Please list the websites you'll be using the theme on and get in contact if you require help with removing the attributions.
We are not obliged to provide free support for free themes. Support is always prioritised for customers using premium (paid) ThemeFlood themes or persons who've previously made a contribution (see above). We would normally expect a contribution for email support provided, relating to free themes. Obviously your email will receive priority treatment if you have made a contribution already or on the promise that you will be doing so shortly!
Also of note, if you require modification and retesting of free themes, a variety of competitive fixed or hourly rates are available to facilitate this service, direct from ThemeFlood. Free themes can be expertly modified and retested to meet your exact requirements. Please get in contact with a project proposal, if you require a non-obligatory estimate of costs and turnaround time.
Theme license agreement
In short, when you purchase a theme from the ThemeFlood website, you are buying a license (assigned to a named person) to use the theme in an unlimited number of personal and commercial projects. The license includes access to technical support and free updates. The person buying the theme license is hereafter referred to as the 'License Holder'.
Unless otherwise advertised, the purchase cost of a theme does not include website hosting, domain name registration, security certificates, additional addons, content setup, website optimisation or other extra's. The free demo versions provided give a reliable indication of what the License Holder will receive.
Ownership of the original theme design, graphics, assets, source code and other elements remains the property of ThemeFlood; with the exception of re-used and appropriately licensed files, assets or resources being used in the theme design (like font faces, icons and opensource code) from another induvidual or organisation.
The License Holder is strictly forbidden from redistributing a theme (in part or whole) in either RapidWeaver format or any other theme or template format. This includes making the theme available for public download on websites, forums, file sharing sites, email or torrents etc.
A theme may only be redistributed if it has been extensively modified. The extent of modification which nullifies ThemeFlood's right to credit and copyright will vary; but in short, no original graphics may remain and the overall layout and file structure (including the list of properties) must vary sufficiently to demonstrate evidence of applied intellectual process.
The License Holder is permitted to duplicate / rename themes for private use. Additionally the License Holder is encouraged to make archival backups of themes, providing that these backups are only accessible to the License Holder.
A theme is permitted to be installed on all laptops and desktop machines owned by the License Holder. In instances where a License Holder wishes to make a theme commonly available in a collaborative or educational environment, a more suitable license will need to be obtained.
ThemeFlood accepts no responsibility for consequential damage caused (to the License Holder, others, hardware / software that the License Holder owns, leases or rents) that may arise from the installation or use of any addons provided through this website. Neither do we promise to honour customer support or updates indefinitely. In general, this means that you choose to use the addons provided through this website at your own risk, and we accept no responsibility for anything that may occur as a result of your use of, or inability to use, the addons provided through this website.
The theme license agreement will be imposed to the maximum extent possible under UK, European and internation laws. We will actively seek prosecution and damages against any induvidual or organsiation in breach of the license agreement.
Copyright and moral protection
ThemeFlood or sites represented by ThemeFlood, holds, recognises, or maintains all copyright and moral right claims to any and all images, likenesses, artwork, logos, names and icons contained on this site and its folders, subfolders, directories and databases, in their entirety, with clear exception given to those who hold rights and/or trademarks and/or product identification that may be advertised or reviewed or discussed on this site. Failure to observe these rights, can and will result in legal action to the greatest extent allowable by UK and international law.
Use of, or reproduction of any of the rights protected materials without the express written consent of ThemeFlood or sites represented by ThemeFlood, or trademark owner, or appropriately appointed designate, is a strict violation of these rights.
RapidWeaver is a trademark of Realmac Software http://www.realmacsoftware.com/.
End User License Agreement (EULA)
RapidWeaver addons obtained from the ThemeFlood site are designed for use with the RapidWeaver platform. Any usage beyond use in RapidWeaver may be construed as unlawful. RapidWeaver addons obtained from the ThemeFlood site may not be redistributed in their original format or any other addon or template format. You may use an addon to develop a web site for profit, provided all credits within the code remain intact, even if said addon has been modified. The extent of modification which nullifies ThemeFlood's right to credit will vary, but in short, no original graphics may remain and the overall layout and file structure (including the list of properties) must vary sufficiently to demonstrate evidence of applied intellectual process.
Free RapidWeaver addons (excluding free demo versions) provided from the ThemeFlood website are provided on an 'as-is' basis and are released under the opensource MIT license.
